KASHUB Competition Application — Privacy Notice

This notice is issued under Article 10 of the Turkish Personal Data Protection Law No. 6698 ("KVKK") to inform users ("Participant") who apply to competitions organised through the KASHUB mobile application ("App"). The App's general Privacy Policy also applies.

2. Personal Data Processed

Because physique photos and height/weight can reveal information about a person's physical condition, they are treated as special-category (health) personal data under Article 6 KVKK and are processed only with your explicit consent as set out below.

3. Purposes of Processing

• Receiving the application, checking eligibility (age, subscription, single account) and preliminary review,
• Evaluation of photos and measurements by the jury against the competition criteria,
• Communicating the outcome, any rejection reason and prize information to the Participant,
• Contacting the Participant by phone/e-mail about the application and competition,
• Detecting fake applications, multiple accounts and manipulated photos,
• Evidencing acceptance of the Terms of Participation and consents given,
• Fulfilling legal obligations and protecting rights in potential disputes.

Your photos are not used for promotion, social media or marketing and are not shared publicly unless you give separate, explicit permission.

4. Legal Bases

• Identity, contact and application records: Art. 5/2-c (performance of a contract — the Terms of Participation), 5/2-ç (legal obligation), 5/2-e (establishment, exercise or protection of a right) and 5/2-f (legitimate interest — fraud prevention) KVKK.
• Physique photos and height/weight (special-category data): your explicit consent under Art. 6/2 KVKK.
• Transfer abroad (see section 5): your explicit consent under Art. 9 KVKK.

5. Recipients

• Jury members: Photos, measurements and age are shared solely for evaluation with jury members bound by confidentiality. The jury does not see your phone number or e-mail address.
• Infrastructure and service providers: Data is stored on the Controller's servers and with cloud storage / hosting providers (services such as Cloudflare and Google Firebase, whose servers may be located abroad). These providers process data only on behalf of and under the instructions of the Controller.
• Authorities: Legally authorised public bodies and courts, on request and to the extent required by law.

Your personal data is not sold or transferred to third parties for marketing purposes.

6. Method of Collection

Your data is collected electronically, directly from you, through the competition application form in the App. Height, date of birth and phone number are pre-filled if previously entered in your profile; weight is suggested from your latest Posing record; every field can be changed by you before submission.

7. Retention

• Application photos and measurements: 12 months after the competition concludes; if you withdraw before evaluation is complete, deleted within 30 days at the latest.
• Application, consent and contact records: for the general limitation period (10 years) for potential disputes, or any shorter/longer period required by law.
• Prize delivery records: for the period required by applicable tax and commercial law.

At the end of the retention period, data is deleted, destroyed or anonymised.

8. Your Rights (Art. 11 KVKK)

By applying to the Controller you may: learn whether your data is processed and request information; learn the purpose and whether it is used accordingly; know the third parties to whom it is transferred in Türkiye or abroad; request correction of incomplete or inaccurate data; request deletion or destruction under Art. 7 KVKK; request that corrections/deletions be notified to recipients; object to a result against you produced solely by automated analysis; and claim compensation for damage caused by unlawful processing.

You may withdraw your explicit consent at any time; withdrawal does not affect processing carried out before it, but since your application cannot be evaluated without the consent-based data (photos, measurements), your application is treated as withdrawn.

Requests may be sent to contact@kashubapp.com or via Settings › Delete Account / support in the App. Requests are answered free of charge within 30 days at the latest; where the process incurs an additional cost, the fee set by the Personal Data Protection Board may be charged.
